Этот документ опубликован на английском языке, и юридическую силу имеет английский текст.
- CantonCap is an information service about the Canton Network, operated by Titan Limited, a company incorporated in the British Virgin Islands. It is not an exchange, a broker, a custodian, a wallet, an adviser or a virtual asset service provider.
- Nothing on CantonCap is investment advice or an offer of any asset. Figures, posts, articles and the assistant’s answers can be late, incomplete or wrong, so check them before you rely on them.
- You must be 18 or over. You may not use CantonCap if you are subject to sanctions, or where using it would be unlawful.
- An account is optional. If you open one, keep it secure, because you are responsible for what is done with it.
- What you post and write stays yours. You give us a licence to show it, you follow the Community Guidelines, and we may remove content or close accounts that break them.
- Paid API access is governed by the API Terms, and the iPhone and Android apps by the App Terms.
- The law of the British Virgin Islands applies and its courts decide disputes, but you keep every protection the law of your country gives you as a consumer.
Краткое изложение помогает читать документ. Действует полный текст ниже.
These Terms of Use (the “Terms”) are a binding agreement between you and Titan Limited, a company incorporated in the British Virgin Islands (“CantonCap”, “we”, “our” or “us”). They govern your use of the Services described below. You accept them when you open an Account, buy a plan, or otherwise use the Services. If you do not agree, do not use the Services. Please read in particular the sections on disclaimers, limitation of liability and governing law and jurisdiction.
1. Definitions and other documents
In these Terms:
- the “Site” is the website at www.cantoncap.cc and the documentation at docs.cantoncap.cc;
- the “App” is the CantonCap application for iPhone and Android, however you obtained it;
- the “API” is the CantonCap application programming interface at api.cantoncap.cc, including its streams;
- the “Services” are the Site, the App, the API, CantonCap accounts, the community, News, the newsletter and our emails, the assistant, and any other feature we offer under the CantonCap name;
- an “Account” is a CantonCap account, and a “Member” is a person who holds one;
- “Member Content” is anything a Member publishes or submits through the Services: posts, replies, reactions, articles with their cover images, reports, and the name, username, photo, biography and links on a profile;
- “Market Data” is the prices, valuations, volumes, liquidity measures, scores, rankings, charts and other figures the Services publish, with their descriptions and metadata;
- the “assistant” is the CantonCap AI Assistant on the Site, which answers questions with an artificial-intelligence model.
These documents also apply and form part of your agreement with us: the Community Guidelines when you take part in the community or write for News, the API Terms when you use the API, and the App Terms when you use the App. Where one of them conflicts with these Terms on its own subject, that document prevails. The Disclaimer explains what the Market Data and other content are and are not, and forms part of these Terms. The Privacy Policy and the Cookie Policy explain how we handle personal data; they are notices, not contract terms.
2. Who we are
The Services are provided by Titan Limited, registered with the Registry of Corporate Affairs of the British Virgin Islands under company number 2194169, Legal Entity Identifier 529900E9GA8R99VOHV41, part of Edel Finance. Our address and the ways to reach us are in the Legal Notice and in section 28.
3. What the Services are, and what they are not
CantonCap publishes market data for assets on the Canton Network: reference prices, fully diluted valuations, traded volumes, liquidity, the venues and markets behind each figure, and how each figure was made. It also offers watchlists and portfolios, a community of Members, News articles written by Members and by the CantonCap desk, a newsletter, the assistant and the API. The data is aggregated from third-party venues, registries, ledgers and reference sources. The methodology describes how each figure is built and what it does not cover.
The Services provide information only. We are not an exchange, a trading platform, a broker, a dealer, a custodian, a wallet provider, an investment adviser, a portfolio manager or a market maker. We do not hold, transfer, exchange or safeguard funds or virtual assets for anyone, we do not execute or arrange transactions, and we do not issue, offer or sell any security or virtual asset through the Services. Nothing in the Services is an offer, an invitation or a solicitation to buy, sell, subscribe for or otherwise deal in any security, virtual asset or other instrument, or a recommendation to do so.
Regulatory status. The Services are not a virtual asset service within the meaning of the Virtual Assets Service Providers Act, 2022 of the Virgin Islands, and Titan Limited is not registered as a virtual asset service provider under that Act. Titan Limited is not licensed under the Securities and Investment Business Act, 2010 of the Virgin Islands and does not carry on investment business through the Services. It holds no licence or registration from the Financial Services Commission of the Virgin Islands, or from any other financial regulator, for the Services. If you need a regulated service, use a provider authorised to offer it where you live.
Some features are introduced in stages and may not be available to everyone, on every platform or in every country at the same time. The Services are free unless a price is shown to you before you buy.
4. Eligibility and restricted use
You may use the Services only if:
- you are at least 18 years old and have the legal capacity to enter into a binding contract where you live;
- you are not a person who is the subject or target of sanctions administered or enforced by the United Nations Security Council, the British Virgin Islands (including the United Kingdom sanctions measures that extend to it), the European Union, the United Kingdom, Switzerland or the United States, and you are not owned or controlled by, or acting for, such a person;
- you are not located in, or ordinarily resident in, a country or region that is subject to comprehensive sanctions or an embargo by any of them; and
- your use of the Services is lawful where you are.
The Services are not directed at any person in a jurisdiction where publishing or receiving them would be unlawful. We may restrict access to all or part of the Services by location, and you must not use a virtual private network or other means to get around a restriction we apply.
If you use the Services on behalf of an organisation, you confirm that you are authorised to bind it, and “you” then includes that organisation.
5. Accounts and security
You can read the Site and use the App without an Account. An Account lets you keep your watchlist on several devices, keep a portfolio, verify wallets, take part in the community, write for News, receive notifications and manage your purchases. You can open one with an email address and a password, with a one-time code sent to your email, or through Sign in with Google or Sign in with Apple, where each is offered.
You agree:
- to give accurate information and keep your email address current;
- to keep your Account for yourself, keep your password and sign-in methods secure, and tell us at once at support@cantoncap.cc if you think someone else has used them;
- not to choose a username, display name or photo that impersonates a person, a company, a venue, an issuer or CantonCap, or that misleads anyone about who you are;
- not to sell, rent or transfer your Account or username, and not to open Accounts to evade a suspension or to amplify yourself.
You are responsible for everything done through your Account, unless it happened because we failed to keep it secure. Usernames reserved for CantonCap staff, and usernames that break these Terms, may be refused or withdrawn.
You can delete your Account at any time, in the Site’s Account settings or in the App’s Account screen. The Privacy Policy explains what deletion removes and what the law requires us to keep.
6. Your licence to use the Services
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the Site and the App for your own information, including in your work. You may quote individual figures and charts from the Site or the App in an article, a post, a report or a presentation, with the attribution “Source: CantonCap” and, where the medium allows, a link to www.cantoncap.cc. Any other reproduction, and any use of Market Data in a product or a service, requires the API and the API Terms, or our written agreement.
7. Acceptable use
You agree not to:
- copy, scrape, crawl or extract data from the Site or the App by automated means, or access the Services by any automated means other than the API used under the API Terms, except search engines indexing public pages in line with our robots instructions;
- circumvent a rate limit, an access control, a paywall, a plan bound or an API key, or access an area of the Services you are not authorised to reach;
- interfere with or disrupt the Services, place an unreasonable load on them, introduce malware, or probe or test their security without our written permission (we welcome responsible reports of vulnerabilities at tech@cantoncap.cc);
- decompile, reverse engineer or disassemble any part of the Services, except to the extent the law expressly permits it;
- create Accounts by automated means, or use Accounts, reactions, votes, follows or reports to manipulate the community;
- use the Services to manipulate a market or a price, to spread information you know or suspect to be false, to promote an asset without disclosing a paid relationship or a holding as the Community Guidelines require, or to deceive anyone;
- use the Services in breach of any law, regulation or sanction, or to offer any financial service you are not authorised to offer;
- try to make the assistant reveal its instructions, act outside its purpose or produce unlawful or harmful content, or submit questions to it by automated means;
- collect personal data about other Members, or contact them for marketing they did not ask for;
- use content of the Services to build or train a dataset or a model that is offered to others or that competes with the Services, without our written agreement;
- misrepresent the source of Market Data, or present it as your own measurement.
8. Your content
Member Content is public, except reports and anything the Privacy Policy describes as private. Anyone can read posts and published articles on the Site and in the App, with or without an Account, and they may be shown on other pages of the Services, such as an asset’s page, a feed, a profile, a search result or a preview card.
You keep ownership of your Member Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, distribute, format and adapt it (for example to fit a screen, a preview card or a language) for the purpose of operating, improving and presenting the Services, including showing it inside and alongside links to the Services. We may let our service providers exercise this licence on our behalf. The licence ends when you delete the Member Content or your Account, except for copies kept for the limited periods the Privacy Policy describes, anything we must keep by law, and content that other people have already shared or quoted.
You are responsible for your Member Content. You confirm that you have the rights needed to publish it and to grant this licence, including for any photo or cover image you upload, and that it complies with the Community Guidelines and the law. Do not post anything you need to keep confidential. If you send us feedback or suggestions, we may use them without obligation to you.
9. Community, News and moderation
The Community Guidelines set out what may be posted or written, how to report content, and how we moderate. We do not review posts before they are published and we are not obliged to monitor them. Articles are reviewed by our team before they are published, unless we have allowed an author to publish directly; a review checks an article against the Guidelines and is not a verification or an endorsement of it.
We may review, hide, remove, decline or restore Member Content, pause a Member’s ability to post, and suspend or close an Account where the Guidelines, these Terms or the law require or justify it. When we restrict your content or your Account, we tell you why and how to ask us to look again, as the Guidelines describe.
Member Content is the opinion of the Member who wrote it. We do not endorse, verify or adopt it, and it is not advice from us. Articles published by the CantonCap desk are our own editorial content and are labelled as such; they are information, not advice.
10. The AI assistant
The assistant answers questions with a large language model provided by Anthropic, PBC, using CantonCap’s data and, where it decides to, searches of the web. Its answers are generated automatically. They can be wrong, incomplete, out of date or inconsistent with the page you asked on, they can misread or misquote a source, and they are not reviewed by a person before you see them.
The assistant’s answers are not investment, financial, legal, tax or trading advice, not a recommendation, and not a statement or a representation by us. Using the assistant does not create an advisory or any other professional relationship. Check anything that matters against the page or the source the answer cites before you rely on it.
Please do not put personal data, confidential information or anything about another person in your questions. You may use the answers for your own information. The assistant has limits per person and per day, and we may change, pause or withdraw it at any time. The Privacy Policy explains what is sent to Anthropic, what we keep and for how long.
11. Market Data, third-party content and links
Market Data is derived from venues, registries, ledgers, issuers and other sources that are independent of us. A reference price is a calculated aggregate, not a quote at which anyone will trade with you. Where the Canton Network’s privacy model makes activity invisible to a public reader, the Services say so, and an absence is a published finding, not a statement that nothing exists. The Disclaimer applies to all Market Data and to all other content in the Services.
Some pages show posts that issuers publish on X. They are shown as the issuers published them, under X’s display rules, and withdrawn when the issuer or X removes them or when their display period ends. They are the issuers’ statements, not ours.
The Services link to and rely on services we do not control, including Apple, Google, Stripe, Anthropic, X, and the venues and issuers we list. Their own terms and policies apply to your use of them, and we are not responsible for their content, conduct or availability. A listing of an asset, a venue or an issuer is a record that it exists on the Canton Network, not an endorsement or a statement that it is lawful, safe or suitable for you.
12. Price alerts, notifications and widgets
Price alerts, notifications, email digests and home-screen widgets are conveniences. They depend on our servers, on push services run by Expo, Apple and Google, on your device’s settings and on your connection, and they can be delayed or fail to arrive. A price that crosses your level briefly may not trigger an alert. Do not rely on them for any decision that depends on timing.
13. Wallets and portfolios
Verifying a wallet proves, by a message you sign, that you control an address. We never ask for your private keys or recovery phrases, and anyone who does is not acting for us. We never hold, move or have access to your assets. A portfolio is a record you keep; its values are estimates at the reference price and can differ from what you would receive if you sold.
14. Paid services and sponsored placements
API plans are sold under the API Terms, which cover prices, renewal, cancellation, refunds and payment by card. Card payments are processed by Stripe Payments Europe, Ltd. and Stripe, Inc.. We never see or store your full card details.
Where we offer another paid feature, such as a sponsored placement for an asset, a venue or an issuer, we agree its price and terms with you before you buy, on the Services or in writing through partner@cantoncap.cc. Sponsored content is labelled “Sponsored” wherever it is displayed, never changes a figure, a ranking or the order of a list it appears beside, and is not an endorsement by us.
15. Newsletter and emails
The newsletter is sent only to addresses that confirmed their subscription, and every issue carries a link to unsubscribe. Notification emails follow the choices in your Account settings and carry their own link to stop them. We also send emails you need to use the Services, such as sign-in codes, confirmations, receipts and notices about your Account, your API keys or these Terms; these are not marketing and cannot be switched off while you hold an Account or a plan.
16. Intellectual property
The Services, their software, design, text, graphics and documentation, the aggregation and the calculated figures (including reference prices, rankings, scores and ratios), the methodology, the CantonCap desk’s articles, and the CantonCap name and marks belong to us or our licensors and are protected by copyright, database, trademark and other laws. The underlying facts, such as a price at a venue at a time, are not ours and are not claimed. These Terms give you no right in our marks except as the brand page allows. Third-party names and marks shown in the Services belong to their owners; the Legal Notice says more.
17. Availability and changes to the Services
We aim to keep the Services available and to publish the state of our sources on the status page, but we do not promise uninterrupted or error-free operation. We may change, suspend or discontinue any part of the Services. Where a change materially reduces something you have paid for, the API Terms say what you are entitled to.
18. Disclaimers
The Services, the Market Data, Member Content, issuers’ posts and the assistant’s answers are provided “as is” and “as available”. To the fullest extent the law permits, we disclaim all warranties, conditions and representations, express or implied, including as to accuracy, completeness, timeliness, merchantability, satisfactory quality, fitness for a particular purpose and non-infringement, and any warranty that the Services will be secure or free of errors or harmful components. If you are a consumer, this section does not affect the rights the law of your country gives you and that cannot be excluded.
19. Limitation of liability
To the fullest extent the law permits, Titan Limited, its directors, officers, employees, contractors and affiliates are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, revenue, trading gains, investments, data or goodwill, arising from or in connection with the Services, however caused, including any loss arising from a decision to buy, sell or hold an asset, or from reliance on Market Data, Member Content, an article, an alert or an answer from the assistant. Our total liability for all claims arising from or in connection with the Services in any twelve-month period is limited to the greater of the amount you paid us for the Services in that period and one hundred US dollars.
If you are a consumer in the European Union, the United Kingdom or Switzerland, we are responsible for loss you suffer that is a foreseeable result of our breaking these Terms or of our failing to use reasonable care and skill, and the limits above apply only as far as the law of your country allows. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or any other liability that cannot be limited or excluded by law.
20. Indemnity
If you use the Services for business purposes, you agree to indemnify Titan Limited and its affiliates against any claim, loss, liability or expense, including reasonable legal fees, arising from your Member Content, your breach of these Terms, or your infringement of a third party’s rights. If you are a consumer, this section applies only to the extent the law of your country allows.
21. Suspension and termination
You may stop using the Services at any time, delete your Account, and cancel a plan as the API Terms describe. We may suspend or end your access to all or part of the Services, including your Account and any API key, if you breach these Terms or the documents that form part of them, if the law or a competent authority requires it, if your use creates a risk for other users, for us or for third parties, or if we discontinue the Services. Where it is reasonable and lawful, we tell you in advance, give you our reasons and give you the chance to put things right.
The sections on your content, intellectual property, disclaimers, limitation of liability, indemnity, governing law and jurisdiction, and any other term that by its nature should continue, survive the end of this agreement.
22. Changes to these Terms
We may revise these Terms, for example when the Services, the law or our providers change. The date at the top records the current revision. We announce material changes on the Services and, to Members and API customers, by email at least fourteen days before they take effect, unless a change is required sooner by law or to address a security risk, or concerns only a new feature. If you do not agree to a change, stop using the Services and delete your Account before it takes effect; continuing to use the Services afterwards means you accept the revised Terms. A change does not apply to a dispute that arose before it took effect.
23. Events beyond our control
We are not responsible for a failure or delay in performing these Terms caused by an event beyond our reasonable control, such as a failure of a source, a venue, a ledger, a network, a hosting or payment provider or a utility, a cyber attack, a natural disaster, an epidemic, war, unrest, or an act of a government or a regulator. We will take reasonable steps to limit the effect of such an event and resume the Services as soon as we can.
24. Assignment and transfer
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours to a company in our group or to a successor to all or part of the Services, provided this does not reduce your rights as a consumer; we will tell you if that happens.
25. Notices
We may give you notices by email to the address on your Account or your order, in the Services, or, for notices to everyone, on this page. An email notice counts as received when we send it, unless we are told it was not delivered. You can give us notices by email to support@cantoncap.cc (or api@cantoncap.cc for the API), or by post to the address in section 28.
26. General
These Terms and the documents that form part of them are the whole agreement between you and us about the Services, and replace anything said before about the same subject. If a provision is found invalid or unenforceable, it is limited to the minimum extent necessary and the rest remains in effect. A failure or delay in enforcing a provision is not a waiver of it. Nothing in these Terms creates a partnership, an agency, an employment or a fiduciary relationship between you and us. Except as the App Terms provide for Apple, no third party has rights under these Terms. These Terms are written in English, and the English text prevails over any translation.
27. Governing law and jurisdiction
These Terms, and any dispute or claim arising from or in connection with them or the Services, including non-contractual disputes, are governed by the laws of the British Virgin Islands. The Eastern Caribbean Supreme Court, in the High Court of Justice of the Virgin Islands (in its Commercial Division where a claim falls within that Division’s jurisdiction), has exclusive jurisdiction, subject to the appeals the law provides.
If you are a consumer, nothing in this section deprives you of the protection of the mandatory provisions of the law of the country where you habitually reside, and you may bring proceedings in the courts of that country. Where that law requires it, we will bring proceedings against you only in those courts.
28. Complaints and contact
If something has gone wrong, please write to support@cantoncap.cc before starting proceedings, saying what happened and what you would like us to do. We acknowledge every complaint, look into it and tell you what we have decided; most problems can be resolved quickly that way. Complaints about content follow the Community Guidelines, and complaints about a charge the API Terms.
